If and when you are banned from the server, you are forbidden to enter the server unless your ban is revoked.
If you and your brother both use the same account, then it is your responsibility to make sure, whether at any point your account has been banned or not. If you wish to avoid this kind of confrontation, don't let your brother to use the same account as you do.
